Defending the manufacturers in these situations is what I do for a living and yes, the vast majority of them are as stated "I screwed up, it must be somebody else's fault"!

Anyway, he must have grabbed that front brake, because the bike allegedly overturned and James went down, suffering "physical pain, suffering, physical impairment, loss of earnings,

Before all you guys are so quick to judge. Perhaps he was a novice but still if in serious traffic perhaps it stopped all of a sudden. I don't really know the specifics but it is possible that he had to panick stop and for that you do need BOTH brakes like I always use equally applied never rear then front. You learn early on when the one time you apply the rear more than the front that you go fishy taily. But I know most morons think the front brake is a novelty I know I have heard more than one ignorant person tell me they like a huge rear tire so they have more stopping power and that front brake are unneccessary.
But too I know my friends rear brakes went out and you do loose stopping power considerably when coming down from a high speed to stopped in a hurry. I rode his kaw with aftermarket rear calipers that just gripped the hairy hell out of the rotors so much so that I used the front brake much more than the rear.
Still the shop must test ride the bikes to make sure that it is in working order. For sure he will win the lawsuit and will he be ahead? Who knows if he is crippled after who cares how much money you get. Your health is always first. The brunt of the responsibility is on him for sure but still the shop carries the blame as well.
Whatever too bad he got hurt. Good maybe this will make novice riders be more cautious or keep fools who think bikes are cars off of the road. I love buying bikes at half the price from people who never ride them because they get "scared" and leave them alone.

Supposedly, the guy was "forced to utilize the front brakes,". If that quote is accurate, then he probably doesn't know how to do a panic stop anyway. Novice or not, he apparently didn't check the bike over before going on his merry way.
